MN Health Dept: Beware of Huge THC Discrepancy

The Minnesota Office of Cannabis Management (OCM) has issued a public warning about a dangerous batch of THC-infused edibles that contain significantly more THC than legally allowed. The advisory centers on the “Oreoz” flavor of delta-9 THC gummies produced by the brand BAK8D, which were found to contain over 100 milligrams of THC per serving—more than 20 times the state's legal limit of 5 milligrams.

These gummies were originally labeled as containing 5 milligrams of THC per piece, but state testing revealed that the actual potency far exceeds this amount. In addition, the flavor did not match the product’s label, raising further concerns about mislabeling and consumer deception.

According to the OCM, other BAK8D products sold online or distributed through tobacco and CBD retailers may also be affected by this issue.

Interim OCM Director Eric Taubel emphasized the importance of xxpublic feedback in identifying potentially hazardous products. “It is important that we know when a consumer has a bad experience with a product, so that our enforcement team can determine if there is an ongoing risk to the public,” Taubel said. “This is an important part of our responsibility to ensure public health and safety, consumer confidence, and market integrity.”

The OCM is encouraging anyone who experiences adverse reactions after consuming these edibles to contact Poison Control immediately at 800-222-1222. Quick reporting helps state authorities take appropriate action, including investigating the manufacturer and potentially removing other unsafe products from the market.

This situation highlights the ongoing need for tighter regulatory oversight in the emerging THC market. While Minnesota continues to develop its adult-use cannabis program, cases like this underscore the potential risks of unregulated or poorly labeled products being sold to the public.

Ensuring accurate labeling, potency, and safety testing is essential not only for consumer protection but also for maintaining the credibility of the legal cannabis industry in the state. As Minnesota works to expand its cannabis oversight, the BAK8D case serves as a clear reminder of the importance of compliance, transparency, and accountability among cannabis producers and retailers.

Consumers are urged to stay informed about product recalls and advisories and to report any negative experiences to the Office of Cannabis Management to help ensure a safer, more reliable cannabis market in Minnesota.
